Experiences & Retreats Booking Terms & Conditions

Read carefully. This is a legally binding agreement.

​

In consideration of being permitted to participate in a Mujer on the Move, Inc. Experience or Retreat (referred to herein as “MOTM Experience” or “MOTM Retreat”), I hereby acknowledge, and agree to the following terms and conditions:

​

All bookings are made with Mujer on the Move, Inc., a California corporation and the owner of all of its advertised itineraries (“Mujer on the Move,” "MOTM x [City Name] Experience" "MOTM Experience," "MOTM Retreat," “we,” or “us”). By booking an Experience or Retreat with us, paying a deposit or signing this agreement, you accept all of the terms in this agreement on your own behalf and direct us to perform services for each and every traveler ("MOTM Aventurera"). 

The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the MOTM Aventurera (“you” or “your”) and Mujer on the Move with respect to any and all bookings, reservations, trips, or transactions made with Mujer on the Move. By signing this Agreement, you also agree to both our MOTM Code of Conduct and MOTM Aventurera Values, which are available by clicking on each perspective hyperlink.

All MOTM Aventureras must be 21 years of age or older to travel with Mujer on the Move unless expressly stated otherwise. When a minor under the age of 18 is permitted on a trip, they must be accompanied by an authorized adult.

I. Travel Insurance MOTM Experiences & Retreats â€‹

​

While Mujer on the Move will always strive to provide safe and secure MOTM Experiences and MOTM Retreats, Mujer on the Move does not offer travel insurance to MOTM Aventureras. However, we strongly encourage Aventureras purchase comprehensive travel insurance on their own to protect against unforeseen circumstances throughout their trip. 

 

Please note that while our MOTM Experiences and MOTM Retreats are designed with safety in mind, inherent risks may be involved. By participating in our Experiences and Retreats, you agree to sign a liability waiver acknowledging and assuming responsibility for any risks associated with your travel.

Furthermore, all Aventureras participating in a MOTM Retreat are REQUIRED to purchase their own  comprehensive travel insurance. â€‹It is mandatory that all Mujer on the Move's Aventureras provide proof of current travel insurance before the MOTM Retreat begins. Travel insurance must cover personal injury, medical treatment, repatriation, and evacuation expenses, including helicopter rescue and air ambulance internationally. It is recommended that travel insurance also address personal property and trip cancellation coverage. Trip cancellation insurance may be the only means of receiving reimbursement for flights and other non-refundable expenses should a Mujer on the Move Retreat be canceled, postponed, interrupted, rescheduled, for any reason, whether voluntarily by you or as a result of Mujer on the Move's actions. You are responsible for understanding the specifics of your travel insurance policy, ensuring that your policy covers all optional and included activities listed in the trip itinerary, and ensuring that there are no exclusion clauses (e.g., air delays due to mechanical issues) that would limit the coverage that you might reasonably need. If you have current health insurance coverage, check your insurance policy to see if it provides the coverage described above while traveling outside your country. It is your responsibility to verify your insurance policy details with your insurance provider to ensure Mujer on the Move's requirements are satisfied.

 

You agree to assume all costs of medical care and transportation that is provided to you. Please note that most companies offering travel insurance require the policy to be purchased within 14 days of the initial trip deposit or payment to any service provider in order to cover pre-existing conditions or to provide for “cancel for any reason” coverage.

 

 

 

​​​​​​​​​​​​II.  MOTM EXPERIENCES | Payments, Refunds, and Cancellations 

​

MOTM Experience bookings may be made through our online booking system (www.mujeronthemove.com) until fully booked. 

​

Credit/Debit Card Charge Authorization

Credit/Debit Card charge authorization for MOTM Experience booking payment. Mujer on the Move accepts most major credits cards (VISA, Mastercard, etc.). If payment fails, however,  your MOTM Experience booking will not be finalized and this will cancel your attempted booking. We also retain the right to assign your spot to the next eligible Aventurera. 

​

Credit/Debit Card Chargeback Policy.

We work hard to make our MOTM Aventureras happy. However, if you are not pleased with Mujer on the Move's services for any reason, you agree not to file a chargeback with your credit or debit card company either directly or through someone else, before you have given us an opportunity to address the matter. By signing this agreement, you agree to work with us in good faith to resolve your dispute and acknowledge that chargebacks are not an appropriate way to avoid our cancellation and refund policies. We will vigorously dispute any chargeback request, provide this agreement as proof that you agreed to our cancellation and refund terms, and reserve the right to report fraudulent chargebacks to authorities. Should we win any chargeback that you initiate, you agree to reimburse us for our attorney’s fees, time, costs and expenses in rebutting the chargeback and pay any damages we suffer as a result of your chargeback dispute.

Cancellations by You and Unused Services

Any MOTM Experience cancellations made by you will abide by our MOTM Experience Cancellation & Refund Policy. Mujer on the Move cannot make any exceptions to this refund policy. For this reason, we strongly recommend you fully read and understand our MOTM Experience Cancellation & Refund Policy before booking.

Special cancellation and refund terms may apply to your MOTM Experience due to "Unforeseen Circumstances" (e.g., during a pandemic such as coronavirus, political turmoil, natural disaster, etc.). 

​

If you decide to cancel your MOTM Experience, the following conditions apply:

​

  • Full Refund: You have 48 after upon booking a MOTM Experience to cancel for full refund. Unless you you book within 2 days before the MOTM Experience, then no refunds will be offered since we typically partner with other businesses or entities and must pay for things like art materials, snacks, etc. ​

​

  • Partial Refund: A 50% refund will be issued if the cancellation is made after 48 Hours of booking your MOTM Experience. Unless you book within 2 days before event, then no refunds will be offered since we typically partner with other businesses or entities and must pay for things like art materials, snacks, etc. ​

​

  • No Refund: No refunds will be issued for MOTM Experience bookings or cancellations made within 2 days of the start date of the experience.

​

Cancellation Process: To cancel your MOTM Experience, you must send written notice to us by email at experiences@mujeronthemove.com. Cancellation fees will be applied per person according to our Cancellation & Refund Policy. 

​

Unused Portion of MOTM Experience (no refunds): There will be no refund for unused services of MOTM Experience due to late arrivals, early departures, etc. There will be no refund once the MOTM Experience has commenced. Your decision not to participate in the MOTM Experience due change of mind, running late, etc. will not warrant a refund. 

​

Furthermore, no refunds will be provided for any unused portion of a MOTM Experience once it begins, including but not limited to if you leave a MOTM Experience for any reason, miss the MOTM's Experience start time or departure, or have to be removed from a MOTM Experience due to violation of MOTM Code of Conduct or MOTM Aventurera Values. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this reason, we highly recommend that you purchase trip cancellation and interruption insurance.

 

 

 

​III. Cancellations or Changes by Us and Flexibility

​

We reserve the right to cancel, alter or modify any MOTM Experience without prior notice for any reason, including but not limited to for the safety and/or comfort of clients and for circumstances of Force Majeure, which is defined in this agreement below. This includes the right to replace or substitute guides and accommodations in the MOTM Experience materials, modify the order in which places MOTM Experience is set to take place, reschedule, postpone or delay your MOTM Experience, and make other changes to the MOTM Experience itinerary. You acknowledge that the MOTM Experience amenities, accommodations, transportation, scheduled artists, chefs, etc., route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include tech breakdown, illness, strikes, political disputes, weather, and other unforeseeable factors. If, prior to MOTM Experience, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.

 

Mujer on the Move shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder as a result of any actions that it takes or does not take under this section and under this Agreement.

 

If we must cancel a MOTM Experience due to insufficient enrollment for reasons not due to Unforeseen Circumstances, all MOTM Aventureras will be notified a minimum of 3 days before the MOTM Experience and will have the option to receive a refund of payments made to Mujer on the Move or to transfer to a comparably priced MOTM Experience without penalty.

 

Any changes may require a supplemental payment from you or result in a partial or full refund. A supplemental payment is a rare situation; however, such a payment may arise due to unexpected events. A refund under this section will constitute full settlement of claims you may have arising out of our cancellation.

VI. Denial of Participation

Mujer on the Move reserves the right to deny participation in a MOTM Experience to any MOTM Aventurera that Mujer on the Move, in its sole discretion, violates these terms including our Code of Conduct, or whose actions or deportment it judges unsuitable for the safety and overall well-being of the group. 

 

During a given MOTM Experience, Mujer on the Move has the right in its sole discretion to remove anyone who it determines to detract from others’ enjoyment of the MOTM Experience. The decision of the guide, host or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. Any costs resulting from being removed from a MOTM Experience or being declined participation in a MOTM experience is at your expense.

V. Photography and Images Release Policy

​By participating in Mujer on the Move MOTM Experiences and MOTM Retreats, you consent to the use of your image and likeness in photographs, videos, and other media for promotional and marketing purposes. This includes, but is not limited to, use on our website, social media channels, printed materials, and other promotional materials.

Your Rights

While we will strive to use your image respectfully, you retain certain rights. You have the right to:

  • Request Removal: You may request the removal of your image from specific media or platforms (email us at customerservice@mujeronthemove.com)

  • Review and Approve: In certain cases, you may have the opportunity to review and approve the use of your image.

  • Compensation: In limited circumstances, you may be entitled to compensation for the use of your image, especially for commercial purposes.

Our Commitment

We are committed to using your image ethically and responsibly. We will not sell or license your image to third parties without your explicit consent.

​

VI. Complaints and Claims

​

If you have any issues or questions during your MOTM Experience, promptly notify your MOTM guide so that we can try to address them.

 

After completion of your MOTM Experience, if you wish to make a claim, submit a complaint, or request reimbursement for any reason, you must do so by email within 5 days after the MOTM Experience's completion. Any and all supporting documentation to the claim or complaint must accompany the email. Any claim or complaint received by Mujer on the Move after this deadline will not be accepted or reviewed. VII. Limits on Responsibility

At no point, and under no circumstances, is Mujer on the Move responsible for payments or costs relating to external services such food, drinks, souvenirs, or any other part of the duration of your MOTM Experience that is not stated in the service and was paid for externally. Mujer on the Move is not obligated to alter any MOTM Experience itinerary or suspend a MOTM Experience's commencement for any reason that prevents you from joining the experience as planned.

VIII. Personal Responsibility

You are responsible for purchasing the style of MOTM Experience that fits your desired comfort level and  activities that are suitable for your fitness level and capabilities. By making a MOTM Experience booking, you acknowledge that Mujer on the Move’s Experiences are adventurous by nature and may involve some personal risk.

IX. Validity of Electronic Signature

If signing electronically, I understand that a paper version of this agreement is available but I have voluntarily chosen to sign this document electronically. I understand that I will receive a link where I can view, print and download a Portable Document Format (PDF) version of this agreement after it is signed at the email address I have provided. To view the PDF document, I understand that I will need software that enables me to receive and access PDF files. In order to print and retain a copy of the agreement, I understand that I will need access to a printer. I understand that I may withdraw my consent to receive communications in electronic form by contacting us by email at info@mujeronthemove.com

X. UPDATING OF TERMS AND CONDITIONS

We may on occasion amend these Terms and reserve the right to update or alter these Terms at any time. Any amendment will take effect seven days after being posted to our website, immediately upon notice to you in writing by email or mail. An up-to-date hard copy of these Terms will be sent to you upon your written request. You are deemed to have accepted any amendments to these Terms on the date that is seven days after their posting on our website or immediately upon notice to you in writing by email or mail. We recommend that you refer to these Terms prior to travel to familiarize yourself with the most up-to-date version available.

 

XI. Merger

This agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.
